These Terms of Service ("Terms") govern your access to and use of Sealpost, an enterprise-grade email hosting and messaging platform ("Service") operated by Sealpost ("we", "us", or "our"). By creating an account, accessing mailboxes, sending or receiving email through our infrastructure, or otherwise using the Service, you agree to be bound by these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.
1. ELIGIBILITY AND ACCOUNTS
You must provide accurate registration information, including a valid administrative contact and, where applicable, domain ownership or authorization to configure DNS for email routing. You are responsible for all activity under your credentials. You must promptly notify us of unauthorized access. We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used in connection with unlawful, abusive, or fraudulent email practices.
2. EMAIL HOSTING AND ACCEPTABLE USE
The Service is intended for legitimate business email, calendaring where offered, and related collaboration. You agree not to use the Service to send unsolicited bulk email ("spam"), phishing messages, malware, or content that infringes intellectual property or privacy rights. You must comply with applicable anti-spam laws (including CAN-SPAM, GDPR where relevant, and regional marketing rules), maintain accurate unsubscribe mechanisms where required, and honor recipient opt-out requests. High-volume sending may require dedicated IP allocation, warm-up procedures, and compliance review. We may rate-limit, throttle, or block traffic that harms deliverability, our networks, or third parties.
3. MAILBOXES, STORAGE, AND DOMAINS
Mailboxes, aliases, storage quotas, and domain limits depend on your subscription plan. You grant us permission to host, transmit, and process email content solely to provide the Service. You remain responsible for the legality of content you store or send. You must configure SPF, DKIM, and DMARC records as we reasonably specify to protect your domain reputation and reduce spoofing. We are not liable for third-party blocklisting or filtering decisions by recipient providers.
4. SECURITY AND ACCESS
You must use strong passwords, multi-factor authentication where available, and secure client configurations. You may not probe, scan, or test the vulnerability of our systems without written authorization. We implement administrative, technical, and organizational measures designed to protect email data; however, no system is perfectly secure. You acknowledge that email transmitted over the Internet may be intercepted outside our control unless end-to-end encryption is explicitly used by you and your correspondents.
5. DATA RETENTION AND DELETION
Retention periods for mailbox data, logs, and backups depend on your plan and applicable law. Upon termination, we may delete data after a defined grace period unless a longer retention is legally required. You are responsible for exporting mail you wish to preserve before closure.
6. INTELLECTUAL PROPERTY
The Service, software, documentation, and branding are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service. You may not reverse engineer our platform except where permitted by law. You retain rights in your content; you grant us a license to host and process it as needed to operate the Service.
7. THIRD-PARTY SERVICES
Integrations (e.g., identity providers, ticketing, CRM connectors) are subject to third-party terms. We are not responsible for third-party outages or data handling outside the Service boundary you configure.
8. FEES AND PAYMENT
Fees are billed according to your order form or online checkout. Late payment may result in suspension. Taxes are your responsibility where applicable. We may change pricing with reasonable notice as described in your agreement or on our website.
9. SERVICE LEVELS AND MAINTENANCE
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated when practicable. Emergency maintenance may occur without advance notice.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we disclaim indirect, incidental, special, consequential, or punitive damages, and loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Service will not exceed the amounts you paid us in the twelve (12) months preceding the claim, except where liability cannot be limited by law.
11. INDEMNITY
You will defend and indemnify us against claims arising from your use of the Service, your content, your violation of these Terms, or your violation of third-party rights, including claims related to email content you send or domains you operate.
12. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws specified in your enterprise agreement, or otherwise by the laws of the jurisdiction where Sealpost is established, excluding conflict-of-law rules. Courts in those jurisdictions have exclusive jurisdiction unless mandatory consumer protections apply.
13. CHANGES
We may modify these Terms by posting an updated version and, where material, notifying you by email or in-product notice. Continued use after the effective date constitutes acceptance.
14. CONTACT
For legal notices and abuse reports related to email on our platform, contact the address published in your account portal.
15. ENTIRE AGREEMENT
These Terms, together with any order form, data processing terms, and acceptable use policies, constitute the entire agreement regarding the Service and supersede prior oral or written understandings.
ADDITIONAL PROVISIONS ON EMAIL DELIVERABILITY AND COMPLIANCE
Deliverability depends on sender reputation, content quality, list hygiene, and recipient engagement. You agree to maintain bounce handling, suppress invalid addresses, and avoid purchased lists without verifiable consent. We may provide guidance on best practices; failure to follow such guidance may affect inbox placement. We do not warrant that messages will be delivered to any particular folder or that they will avoid spam classification by receiving systems.
You acknowledge that email metadata (headers, routing information, timestamps) may be processed for security, troubleshooting, abuse prevention, and analytics in aggregated form. You must not misrepresent message origins or manipulate headers in ways that deceive recipients or systems.
If you operate mailing lists, you must document consent where required, provide identification in messages, and process complaints promptly. We may cooperate with regulators and law enforcement when legally compelled regarding email-related investigations.
The Service may include filtering for malware and phishing. False positives may occur; you are responsible for reviewing quarantines and release decisions according to your security policies.
Enterprise customers may receive custom terms that prevail over these Terms where explicitly stated. In case of conflict, the enterprise agreement controls for those customers.
By using Sealpost for business email, you confirm that you understand the shared responsibility model: we secure the platform; you secure accounts, clients, and content policy. This division is essential for regulatory frameworks that address both processor and controller obligations in email contexts.
These Terms will survive termination to the extent necessary to enforce accrued rights, confidentiality, indemnity, limitation of liability, and dispute resolution provisions.
